SommGeo is operated by Ajax Cellars LLC, doing business as SommGeo, Aspen, Colorado (“SommGeo”, “we”). By creating an account or using sommgeo.com, app.sommgeo.com, or any SommGeo tool, you agree to these terms.
1. Accounts and membership
Membership is personal to you. One login, one person. Sharing credentials or reselling access is not permitted and may result in cancellation.
Free trials require a payment method and convert to a paid membership at the end of the trial unless cancelled first. Memberships renew automatically at the rate shown at checkout until you cancel. You can cancel anytime from your account page; access continues to the end of the paid period. Payments are processed by Stripe. We do not store card numbers. Partial periods are not refunded.
Prices may change. We will give notice before a change affects a renewal.
2. Intellectual property
All maps, data compilations, text, images, tours, tools, and software on SommGeo are the property of SommGeo or its licensors and are protected by copyright. Basemaps, imagery, and terrain are provided by Esri and its data partners under their own terms, and their attribution must remain visible wherever it appears.
3. Using the maps
How maps may be used is set out on our Map Usage, Credit and Licensing page, which forms part of these terms. In short: personal study is free with membership; sharing or teaching with a visible SommGeo credit is free; any commercial use requires a Commercial Embed License or a separate written agreement.
You may not scrape, bulk download, extract, re-host, or redistribute SommGeo map data, layers, or boundaries, or use automated tools to do so. Maps created with Map Maker are for your own study and teaching and may not be published commercially or re-hosted as a standalone product.
4. Commercial Embed License
A Commercial Embed License is a monthly subscription that permits one business to embed SommGeo 2D and 3D maps on the number of websites and embeds its tier allows (Estate: one website, up to three embeds; Portfolio: one website, unlimited embeds; Group: up to five websites or brands, unlimited embeds), and to use map screenshots in its marketing, print, packaging, and menus, on these conditions: the SommGeo credit remains visible on the map and appears on or next to every printed or static use; maps are used as provided, without restyling, edits, or removal of branding; the license cannot be sublicensed or transferred; embed codes are issued to one business for the website(s) named at setup and may not be shared, republished, or used on any other site, and SommGeo may refuse to serve a map to any site other than the licensed one; it ends when payment stops or on 30 days’ notice from either side. Portfolio and Group tiers also include static image exports from the commercial Map Makers, which carry the SommGeo credit and may not be altered to remove it. Tours are not included. SommGeo may update, replace, or retire individual maps at any time.
5. Accuracy
SommGeo maps are original cartography built from official regulatory and government sources and interpreted from the best available data. They are for education and reference. Boundaries may not reflect the most recent regulatory changes, and nothing on SommGeo is professional, legal, or commercial advice.
6. Acceptable use
Do not interfere with the site or apps, attempt to access accounts or systems you are not authorized to use, or use SommGeo in violation of any law. You must be at least 18 to hold an account.
7. Third-party services
SommGeo relies on third-party services including MemberPress, Stripe, Esri ArcGIS, and Cesium. Their availability and terms are outside our control. Where a SommGeo app carries its own terms, those apply in addition to these.
8. Disclaimer and limitation of liability
SommGeo is provided “as is.” We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, SommGeo is not liable for indirect, incidental, special, or consequential damages, including lost business, revenue, profits, or data, arising from your use of or inability to use the site, apps, or maps. Our total liability for any claim is limited to the amount you paid to SommGeo in the twelve months before the claim.
9. Infringement notices
If you believe content on SommGeo infringes your rights, email greg@sommgeo.com with a description of the work, where it appears on our site, your contact details, and a statement that you have a good-faith belief the use is not authorized. We will respond and, where appropriate, remove the material.
10. Changes and governing law
We may update these terms. Continued use after an update means you accept it. These terms are governed by the laws of the State of Colorado. Any dispute will be brought in the state or federal courts located in Colorado.
